Throughout these Terms, “Label’d”, “we”, “us” and “our” refer to Label’d Ltd, the company operating this website.

These Terms & Conditions apply when you access our website or purchase goods from us.

Nothing in these Terms affects your statutory rights as a consumer.

2. Our Online Store

By placing an order through our website, you confirm that you are legally capable of entering into a binding contract.

You must ensure that the information you provide when placing an order is accurate and complete.

You must not use our website or products for unlawful or fraudulent purposes.

3. Products

We make reasonable efforts to ensure that product descriptions, photographs, sizes, colours, condition information and other details displayed on our website are accurate.

Colours and appearance may vary slightly depending on your device or display settings.

Where an item is pre-owned or vintage, reasonable signs of previous use may be present. We aim to describe significant condition details accurately where relevant.

Product availability is subject to change.

4. Authenticity

Where products are described as genuine or authentic branded goods, Label’d Ltd takes reasonable steps to ensure their authenticity.

If you believe there is an authenticity issue with an item you have purchased, contact us at customerservice@labeld.co.uk so that we can investigate.

Nothing in this section limits any rights you have where goods are not as described.

5. Prices

Prices are displayed in the currency applicable to the market selected on our website.

The total price payable, including applicable delivery charges, will be displayed before you complete your order.

Label’d Ltd is not currently VAT registered.

We reserve the right to change prices at any time, but changes will not affect an order that has already been accepted by us.

If an obvious pricing error occurs, we may contact you before accepting or fulfilling the affected order.

6. Orders and Contract Formation

When you place an order, you are making an offer to purchase the products in your order.

Receiving an automated order acknowledgement does not necessarily mean that we have accepted your order.

A contract between you and Label’d Ltd is formed when we confirm acceptance of your order or dispatch the goods, as applicable.

We may refuse or cancel an order before acceptance where reasonably necessary, including where:

an item is unavailable;
payment cannot be authorised;
we identify an obvious pricing or product-information error;
we reasonably suspect fraud or misuse; or
we are unable to fulfil the order.

If payment has already been taken for an order that we cannot fulfil, the relevant amount will be refunded.

7. Payment

Available payment methods are displayed during checkout.

You agree to provide current, complete and accurate payment and billing information.

Payments may be processed by third-party payment providers. Their own terms and privacy practices may also apply to their services.

8. Delivery

Available delivery methods, charges and estimated delivery times are displayed during checkout where applicable.

Our separate Shipping & Delivery Policy provides further information about processing, dispatch, delivery and international orders.

Delivery estimates are estimates unless a delivery service is expressly stated to be guaranteed.

Nothing in these Terms limits your statutory rights regarding delivery.

9. International Orders

We may offer delivery to countries outside the United Kingdom.

International orders may be subject to customs procedures, import duties, taxes or other charges imposed by the destination country.

Where these charges are not collected by Label’d during checkout, you may be responsible for paying them.

You are responsible for ensuring that products ordered can lawfully be imported into the destination country.

10. Your Right to Cancel

If you are a UK consumer purchasing goods online, you will normally have a statutory right to cancel your contract within 14 days after the day you receive the goods, subject to applicable legal exceptions.

After notifying us of your cancellation, you must return the relevant goods within the applicable statutory timeframe.

Our Refund & Returns Policy explains how to request and complete a return.

Nothing in these Terms restricts your statutory cancellation rights.

11. Returns and Refunds

Our 14-day returns policy and information about statutory cancellation rights are set out in our Refund & Returns Policy.

Unless goods are faulty, damaged, incorrect or not as described, you may be responsible for the cost of returning them where permitted by law and where you have been informed of this requirement.

Sale and clearance pricing does not by itself remove statutory consumer rights.

Nothing in our Returns Policy or these Terms affects your statutory rights.

12. Faulty or Misdescribed Goods

We are under a legal duty to supply goods that conform to the contract.

Goods must meet the standards required by applicable UK consumer law, including requirements concerning satisfactory quality, fitness for purpose and conformity with their description where applicable.

If you believe an item is faulty, damaged, incorrect, counterfeit or not as described, contact customerservice@labeld.co.uk.

Nothing in these Terms limits the remedies available to you under applicable consumer law.

13. Promotions and Discount Codes

From time to time, Label’d may offer promotions, discount codes or special offers.

Additional conditions may apply to individual promotions and will be communicated with the relevant offer where applicable.

Unless stated otherwise, promotional codes have no cash value and cannot be exchanged for cash.

We may refuse a promotional code where it has expired, does not meet its stated conditions or is being used fraudulently or contrary to the terms of the promotion.

Your statutory rights are unaffected.

14. Website Information

We aim to keep information on our website accurate and up to date.

However, occasional typographical errors, inaccuracies or omissions may occur.

Where an error affects an order you have placed, we will deal with it reasonably and in accordance with applicable consumer law.

15. Intellectual Property

Unless otherwise stated, the content created for this website, including our own text, graphics, branding, layout and other original materials, belongs to Label’d or is used with permission.

Third-party trademarks, product names and brand names remain the property of their respective owners.

The sale of genuine branded goods by Label’d does not imply sponsorship, endorsement or affiliation with the relevant brand unless expressly stated.

You may not reproduce or commercially exploit our proprietary website content without permission except where permitted by law.

16. Acceptable Use

You must not knowingly:

use our website for unlawful or fraudulent activity;
attempt to interfere with the operation or security of the website;
introduce malicious software or harmful code;
attempt to gain unauthorised access to our systems;
misuse another person’s information; or
use automated systems in a manner that unreasonably disrupts our website.

We may restrict access where reasonably necessary to protect our website, customers or business.

17. Third-Party Services and Links

Our website may contain links to or integrations with services operated by third parties.

We are not responsible for third-party websites or services that we do not control.

You should review the applicable terms and privacy information before using third-party services.

18. Privacy and Cookies

We process personal information in accordance with our Privacy Policy.

Information concerning cookies and similar technologies, including available privacy choices, is provided through our Privacy Policy and cookie-preference controls.

19. Our Responsibility to You

Nothing in these Terms excludes or limits liability where doing so would be unlawful.

In particular, nothing excludes or limits liability for death or personal injury caused by negligence, fraud or fraudulent misrepresentation, or any other liability that cannot legally be excluded.

We are responsible for losses that are a foreseeable result of our breach of these Terms or our failure to use reasonable care and skill.

If you are purchasing as a consumer, we are not responsible for business losses arising from your use of products for commercial purposes where those losses are not protected by applicable consumer law.

20. Events Outside Our Reasonable Control

We will not be responsible for delay or failure caused by circumstances outside our reasonable control where the law permits.

Where such circumstances affect an order, we will take reasonable steps to minimise their impact and communicate with you where appropriate.

Your statutory rights remain unaffected.

21. Changes to These Terms

We may update these Terms from time to time to reflect changes to our business, website, services or applicable law.

The Terms applicable to your purchase will generally be those in effect when your contract with us was formed.

22. Severability

If any provision of these Terms is found to be unlawful, invalid or unenforceable, the remaining provisions will continue to apply to the extent permitted by law.

23. No Waiver

If we do not immediately enforce a provision of these Terms, this does not mean that we have waived our right to enforce it later.

24. Governing Law

These Terms and contracts between you and Label’d Ltd are governed by the laws of England and Wales, subject to any mandatory consumer protections that apply to you.

If you are a consumer resident elsewhere in the United Kingdom, you may also benefit from mandatory protections and rights to bring proceedings available under the laws applicable where you live.

Nothing in these Terms removes any mandatory rights available to consumers.
